Release of Liability

Using the facilities and participating and engaging in any activity of Life Design Brands LLC (dba Plank Training Club) and its sponsors, joint ventures, and affiliates, involves the risk of injury to you or your children, whether you or someone else causes it.  Specific risks vary from one activity to another and the risks range from minor injuries to major injuries, including death.  In consideration of this you understand and voluntarily accept this risk and agree that Plank Training Club, its owners officers, directors, employees, volunteers, agents, and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss, or any damage to you, your spouse, guests, unborn child, or relatives resulting from any negligence of Plank Training Club or anyone on Plank Training Club’s behalf or anyone using the facilities whether related to exercise or not. You agree to indemnify, defend and hold Plank Training Club harmless against any liability, damages, defense costs including attorney fees, or from any other costs incurred in connection with claims for bodily injury, wrongful death, or property damage caused by your negligence or Plank Training Club’s negligence.

Further, you understand and acknowledge that Plank Training Club does not manufacture fitness-related equipment and instead purchases and/or leases the equipment, and that Plank Training Club may not be held liable for defective equipment.

Further, you acknowledge that Plank Training Club did not give you medical advice relating to your physical condition and ability to use the facility and engage in activities.

By clicking on the website during the registration checkout process, you acknowledge and agree that you have read the foregoing and know of the nature of the activities at Plank Training Club and you agree to all terms herein.

Media Release

You give permission and grant to Life Design Brands LLC, dba Plank Training Club (Plank Training Club) the full right to use photographs, testimonials, and/or recordings that pertain to you – including but not limited to your likeness, image, and voice – in connection with Plank Training Club production(s) in any manner or form and for any lawful purpose at any time.  The term “use” encompasses all business purposes in all domestic and foreign markets forever, including but not limited to art, advertising, publicity, marketing, commercial purposes, sales, promotion, training, recruitment, and on any Life Design Brands and Plank Training Club internet web page.  The term “use” also encompasses recording, editing, modification or alteration, reproduction and publication.  You understand that the term “photograph(s) as used herein encompasses both still photographs and motion picture footage (video).  The photograph(s) and recordings may be used in whole or in part in any printed or electronic matter related thereto.  You waive any right to royalties or compensation now or in the future.  You waive any right to review the finished product or the use to which it may be applied.  Consequently, Plank Training Club may publish materials, use your name, and photograph(s) and make reference to you in any manner that Plank Training Club deems appropriate.  You understand and acknowledge that Plank Training Club as referenced herein includes Plank Training Club, Life Design Brands LLC, its owners, its employees and affiliates, agents, contractors, legal representatives, designees, successors and assigns.

You further acknowledge and agree to release, indemnify and hold harmless Plank Training Club and any of their associated companies who use the photograph(s) and recordings from any and all claims whatsoever arising out of, related to or based on the photograph(s) and recordings described herein.
